1. Acceptance of terms
By accessing or using Tellnest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time. Continued use after changes constitutes acceptance.
2. Description of service
Tellnest is a platform that allows users to upload, host, and share HTML files as web pages via shareable links. We provide hosting infrastructure, access control features, and sharing tools. We do not generate, edit, or modify user content.
3. User content and responsibility
You are solely responsible for any content you upload, publish, or share through Tellnest. By uploading content, you represent and warrant that: (a) you own the content or have the right to share it; (b) the content does not violate any law or regulation; (c) the content does not infringe on the intellectual property, privacy, or other rights of any third party. Tellnest does not claim ownership of your content. You grant Tellnest a limited license to store and serve your content solely to provide the Service.
4. Prohibited uses
You may not use Tellnest to upload, host, or share content that: • Is illegal under applicable law • Contains malware, phishing pages, or scripts designed to harm or deceive others • Constitutes hate speech, harassment, or threats of violence • Infringes on copyrights, trademarks, or other intellectual property rights • Contains child sexual abuse material (CSAM) — this is an absolute prohibition and will be reported to NCMEC • Impersonates another person or organization in a misleading way • Is designed to scrape, spam, or interfere with other services We reserve the right to remove content and terminate accounts that violate these terms, at our sole discretion.
5. DMCA / copyright takedowns
If you believe content on Tellnest infringes your copyright, send a DMCA notice to hello@tellnest.com including: (a) identification of the copyrighted work; (b) identification of the infringing content and its URL; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf. We will respond to valid DMCA notices expeditiously by removing or disabling access to the identified content.
6. Platform liability (Section 230 / safe harbor)
Tellnest is an interactive computer service provider. Under 47 U.S.C. § 230 (Communications Decency Act), Tellnest is not the publisher or speaker of user-generated content hosted on the platform. We are not liable for content created or uploaded by users. We are not liable for any harm, damages, or losses arising from user content, provided we have not been notified of illegal content and failed to act. Upon receiving a valid abuse report, we will investigate and act expeditiously.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.
8. Limitation of liability
To the maximum extent permitted by law, Tellnest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability to you for any claims under these terms shall not exceed the amount you paid us in the 12 months prior to the claim.
9. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may terminate your account at any time by contacting hello@tellnest.com.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where Tellnest is incorporated, without regard to conflict of law principles.
